Additional terms for the MTA between PROVIDER and RECIPIENT

ANCILLARY TERMS FOR UCSD TSIEN FP MATERIAL

These plasmids contain material that is being provided to Recipient Institution as a result of the work of DR. ROGER Y TSIEN while he was a Howard Hughes Medical Institute (“HHMI”) Investigator at his laboratory at the University of California, San Diego (“UCSD”), for research purposes in Recipient Investigator’s laboratory only. The material is experimental in nature and must be used with prudence and appropriate caution, since not all of its characteristics are known. Any fluorescent protein(s) contained in the material may be claimed in issued patents owned or controlled by the Regents of the University of California and/or third parties.

THE MATERIAL IS PROVIDED WITHOUT WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTY, EXPRESS OR IMPLIED. THE MATERIAL IS PROVIDED WITHOUT REPRESENTATION OR WARRANTY THAT THE USE OF THE MATERIAL WILL NOT INFRINGE ANY PATENT OR OTHER PROPRIETARY RIGHT.

The material may not be used for any commercial purpose or for work on human subjects, including diagnostic testing.

The material must not be distributed to laboratories of for-profit companies.

The material may be distributed to other non-profit laboratories only with the University of California’s prior consent, in writing, as demonstrated through the completion of the Tsien HHMI Florescent Protein MTA form and a returned acknowledgment email from UCSD. Notwithstanding the foregoing, RECIPIENT may deposit and distribute MODIFICATIONS containing this material via the European Plasmid Repository if the MTA contains these Ancillary Terms for UCSD Tsien FP Material.

In addition, Recipients may transfer the material to other non-profits only under an agreement that prohibits further transfer of the material and the use of the material for commercial purposes or for work on human subjects, including diagnostic testing. This includes transfer of MODIFICATIONS of this material via the European Plasmid Repository using these Ancillary Terms for UCSD Tsien FP Material.


Additional terms for the Order Agreement between RECIPIENT and the European Plasmid Repository

EPR will transfer on their behalf the following personal information to the Technology Transfer office of UCSD (University of California San Diego): the identity of the plasmids being ordered, RECIPIENT SCIENTIST name, RECIPIENT SCIENTIST email address, RECIPIENT name, and RECIPIENT address. (This is needed because the plasmids being requested contain material owned by UCSD.)
